General

These General Terms and Conditions apply to you as a consumer when you purchase products from us, The Every , reg. no. 559310-6189, on our website www.the-every.com. By purchasing a product at the-every.com, you confirm that you accept these Terms and Conditions.

When placing an order on the website, a purchase agreement is entered into between you and The Every we have confirmed your order in writing and you have received our order confirmation. We ask you to save the order confirmation in order to facilitate correspondence with us regarding your purchase.

You must be at least 18 years old to purchase products at the-every.com.

Prices & Payment

All applicable prices for products are listed on the-every.com. We reserve the right to adjust prices; adjusted prices will be published and made available on our website, the-every.com. The prices listed on the-every.com include VAT.

In the event that a product is listed at an incorrect price due to a typographical or technical error, or for any other reason, we reserve the right to refuse or cancel any order placed for such product.

We currently accept Visa and MasterCard through the payment solution Klarna. When paying by card, you will be asked to provide your card number, expiration date, and CVV code. We use 3D Secure, developed by Visa and MasterCard, to secure payments, and all payment information is encrypted using SSL encryption, which prevents unauthorized access to card details.

For customers residing in Sweden, Denmark, Norway, Finland, Germany, and the Netherlands, we also offer payment by invoice in cooperation with Klarna. A standard credit check will be performed when you select Klarna Invoice as your payment method at checkout. Payment must be made within 14 days of purchase; otherwise, a late fee will be added to the invoice amount. For more information about Klarna’s payment terms, please clickhere.

Please note that when ordering against an invoice, the shipping address must be your registered residence.

Shipping & Delivery

The listing or description of a product on the-every.com does not imply that the product is currently in stock.

Products purchased on the-every.com are shipped on regular business days, Monday through Friday, excluding Swedish public holidays.

Orders are delivered by Schenker within the EU and the UK. You will receive an email with a tracking number when your order leaves our warehouse.

Delivery time is 2–8 days. Please note that delivery times may vary.

Terms and Conditions and Right of Withdrawal

These Terms and Conditions apply to every purchase you make.

You have the right to cancel your purchase within 14 days of the product’s delivery date, for any reason or no reason at all. If you have ordered more than one product and the products are delivered separately, or if you have ordered a product that is delivered in separate parts at different times, you have the right to cancel the purchase within 14 days from the day the last product or the last part of the product is delivered.

If you wish to withdraw from your purchase, you must notify us within 14 days from the date of delivery by sending a message to us stating that you wish to withdraw from the purchase and return the product. The message should include your name, address, and contact information. You may send the message to us by email: help@the-every.com or by mail: The Every , Box 136, Sveavägen 124, 113 50 Stockholm, Sweden. You may also usethe Swedish Consumer Agency’s standard withdrawal formand send it to us by mail or email. You will then have 14 days to return the product to us.

Provided that the product is sealed, unused, and returned to us intact and in its original packaging, we will refund you the total cost of the product.

Please note that you, as a customer, are responsible for the products during delivery when the product is returned to us. Please package the products in a suitable manner to minimize the risk of them being damaged or lost during delivery.

Complaints

If you have received a damaged or defective product, please submit your complaint to us by email: help@the-every.com or by mail: The Every , Box 136, Sveavägen 124, 113 50 Stockholm, Sweden, as soon as possible after you discover the defect. If you file the complaint within two months of discovering the defect, the complaint will always be considered to have been filed in a timely manner. However, if you do not file a complaint within three years of ordering the product, you will have no right to claim the defect.

We will handle your complaint in accordance with applicable consumer protection legislation and with the guidelines provided by the Swedish National Board for Consumer Disputes (Sw. Allmänna Reklamationsnämnden, (“ARN”)) (seewww.arn.se).

Please note that even though we hope you are very happy with your product, you are not entitled to compensation if the only reason for your complaint is that you are dissatisfied with the product.

Force Majeure

The Every is not liable for defects or delays caused by circumstances beyond our reasonable control, such as general labor disputes, war, fire, changes to regulations issued by government authorities, problems with power lines or telephone communications, data transmissions, or any other form of communication, or defects or delays in deliveries by subcontractors.

Changes and Additions

The Every the right to modify or amend these Terms and Conditions at any time. You are bound by the Terms and Conditions in effect at the time of your purchase. Any modifications or amendments to these Terms and Conditions apply to all purchases made after their publication on the-every.com. For this reason, please check the-every.com regularly.

We are always delighted to see photos of our products in real life on social media, and we may occasionally ask to share these photos on our channels. The photos are primarily published on our website but may also be shared on one of our other channels.

By responding to our request with the hashtag #yestheevery, you agree to the following:

You grant The Every , reg. no. 559310-6189, a non-exclusive, royalty-free, worldwide license to use any photos you have submitted with the hashtag #yestheevery, hereinafter referred to as “photo,” in its marketing and/or advertising, including in the gallery on its website, newsletters, catalogs, emails, and other customer communications, as well as in store materials and for other marketing purposes.

I hereby certify that (i) you own all rights to your photos, (ii) you have obtained permission from any person appearing in your photos to transfer the rights described herein, and (iii) the use of your photos by The Every will not infringe on any third party’s rights or violate any law.

By this agreement, you release The Every from all obligations to pay you for the use of your photographs and for the intellectual property rights associated with the uses described above, thereby indemnifying and agreeing to hold harmless The Every and all persons acting on behalf of The Every from any and all claims, demands, and liabilities, regardless of nature, arising from the use of the photographs as described above.

Governance, Law, and Disputes

These Terms and Conditions shall be governed by and construed in accordance with the laws of Sweden. Any dispute arising out of these Terms and Conditions shall be finally settled by the general courts of Sweden.

Mobile Terms of Service

The Every messaging service (the “Service”) is operated by The Every The Every,The Every“we,” or “us”). Your use of the Service constitutes your agreement to these terms and conditions (“Mobile Terms”). We may modify or cancel the Service or any of its features without notice. To the extent permitted by applicable law, we may also modify these Mobile Terms at any time, and your continued use of the Service following the effective date of any such changes shall constitute your acceptance of such changes.

By consenting to The EverySMS/text messaging service, you agree to receive recurring SMS/text messages from and on behalf of The Every your wireless provider to the mobile number you provided, even if your mobile number is registered on any state or federal Do Not Call list. Text messages may be sent using an automatic telephone dialing system or other technology. Service-related messages may include updates, alerts, and information (e.g., order updates, account alerts, etc.). Promotional messages may include promotions, specials, and other marketing offers (e.g., cart reminders).

You understand that you are not required to sign up for this program in order to make any purchases, and your consent is not a condition of any purchase from The Every. Your participation in this program is entirely voluntary.

We do not charge for the Service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message frequency varies. Message and data rates may apply. Check your mobile plan and contact your wireless provider for details. You are solely responsible for all charges related to SMS/text messages, including charges from your wireless provider.

You may opt out of the Service at any time. Text the single keyword command STOP to The Every click the unsubscribe link (where available) in any text message to cancel. You’ll receive a one-time opt-out confirmation text message. No further messages will be sent to your mobile device, unless initiated by you. If you have subscribed to other The Every message programs and wish to cancel, except where applicable law requires otherwise, you will need to opt out separately from those programs by following the instructions provided in their respective mobile terms.

We may change any short code or phone number we use to operate the Service at any time and will notify you of these changes. You acknowledge that any messages, including any STOP or HELP requests, that you send to a short code or phone number we have changed may not be received, and we will not be responsible for honoring requests made in such messages.

The wireless carriers supported by the Service are not liable for delayed or undelivered messages. You agree to provide us with a valid mobile number. If you get a new mobile number, you will need to sign up for the program using your new number.

To the extent permitted by applicable law, you agree that we will not be liable for any failure, delay, or misdelivery of information sent through the Service, any errors in such information, and/or any action you may or may not take in reliance on the information or the Service.
